Terms and Conditions

The service may include the creation of a personalized digital book and/or the ordering of a printed book. The digital book is delivered electronically, for example as a PDF file or download link. The printed book is produced only after the customer confirms the order and is a personalized product created according to the customer's submitted data, preferences, and uploaded photos.

If the customer orders a printed book, the customer acknowledges that this is a product customized according to the customer's wishes or for a specific person.

Depending on the offer shown on the website, the service may include:

• preview features (for example a free or promotional cover or sample preview) so you can see how personalization may look before you pay for full generation,
• generation of a full personalized digital children's book using artificial intelligence after you pay the applicable digital fee,
• optionally placing a separate order for a printed (paper) book through checkout, where print is offered.

Digital and print may be priced and charged separately. Print fulfillment is arranged with print-on-demand partners as described at checkout.

Use of preview features is voluntary and does not oblige you to buy the full digital book or a printed book.

When you order a printed book, you confirm your order details (including shipping information) and acknowledge that you have had a reasonable opportunity to review the digital book and/or preview materials that form the basis of the print order. Print production is started only after we have received a confirmed print order and successful payment of the print order where payment is required.

You are responsible for the accuracy of text, names, shipping addresses, and images you submit. Errors in customer-supplied content generally do not constitute a defect in our performance.

By placing an order, you agree to pay the price shown for that product (digital generation, print, or both, as applicable).

Payment is processed securely via third-party payment providers (for example Stripe). Digital generation may begin immediately after successful payment for the digital product, as explained at purchase. Print manufacturing and shipping are initiated only after the print order is confirmed and any required print payment has succeeded.

We reserve the right to refuse or cancel any order in case of:

• suspected fraud,
• obvious technical errors in pricing or listings,
• violation of these Terms.

The digital book is a personalized digital product.

Delivery is made electronically via:

• email, and/or
• access through your user account, and/or
• a download link.

Delivery is typically completed within minutes but may take longer due to technical processing or third-party systems.

We do not guarantee uninterrupted or error-free operation of the website or generation pipeline.

The printed book is a personalized product made to order, typically by a print-on-demand partner, using the specifications and content you confirmed in the order flow (including text and images you supplied).

Indicative production or delivery times shown on the website or in emails are estimates only and are not binding guarantees. Title and risk of loss in transit may pass according to carrier practice and applicable law once the shipment has been handed to the carrier, without prejudice to your statutory rights regarding defective goods or non-delivery where those rights apply.

Because the printed book is custom-made for you, rights of withdrawal for customized goods may be limited under applicable law once production has started with your agreement.

Digital personalized book: due to personalization and because performance may begin immediately after payment, the statutory right of withdrawal may not apply once performance has started with your express consent, as explained at purchase. Refunds may be considered where required by law or in cases such as technical failure preventing access or delivery of the digital product, duplicate payment, or other exceptional circumstances at our reasonable discretion.

Printed personalized book: if the print has a manufacturing defect or arrives materially damaged in transit, contact us at support@magicalbook.store without undue delay with a clear description and, where possible, photographs. We will work with you and the printer to remedy, replace, or refund where justified under these Terms and applicable consumer law.

General complaints: for any complaint about the service, contact support@magicalbook.store. We will respond within a reasonable time.

To use the Service, you may upload photos ("User Content").

You confirm that:

• you own the photos or have legal permission to use them,
• you have permission to upload photos of any persons shown, including minors,
• you grant us permission to use the photos solely to generate the personalized book and, where you order print, to produce the printed book.

You retain ownership of your photos; we use them only as needed to perform the Service.

All website content, software, and technology are owned by Jan Drobčinský.

You receive a non-exclusive license to use the generated book for personal use.

You may not:

• resell,
• redistribute,
• or commercially exploit the generated content without permission.

To the maximum extent permitted by law, Jan Drobčinský shall not be liable for:

• indirect damages,
• loss of profits,
• loss of data,
• or service interruptions.

Total liability shall not exceed the amount you paid to us for the specific product or order giving rise to the claim (digital and print amounts considered separately where applicable).

We may modify, suspend, or discontinue the Service at any time without notice.

We are not liable for downtime or interruptions.

Your use of the Service is also governed by our Privacy Policy.

These Terms are governed by the laws of the Czech Republic and the European Union.

Any disputes shall be resolved in courts located in the Czech Republic.
